Driver Critically Injured in Los Angeles Car Accident

Davida Sullivan, 30, was critically injured in a Los Angeles car accident the afternoon of May 9, 2011. According to a City News Service report, the injury collision occurred on McBean Parkway in Santa Clarita, when the driver of a 1999 Mercedes-Benz, Sullivan, made a left turn into the Ralphs Shopping Center in Santa Clarita, in front of a northbound 2009 Chevy Silverado. Sullivan was transported to a local hospital in critical condition. The driver of the Chevrolet sustained non-life-threatening injuries. An investigation is ongoing.

Right-of-Way Issues

Based on this news report, Sullivan pulled out in front of the other vehicle while attempting a left turn into a shopping center. It is not clear who had right-of-way at the time. California law is very specific about when and how motorists should make left turns or U-turns at street intersections.

California Vehicle Code Section 21801 (a) states: “The driver of a vehicle intending to turn to the left or to complete a U-turn upon a highway, or to turn left into public or private property, or an alley, shall yield the right-of-way to all vehicles approaching from the opposite direction which are close enough to constitute a hazard at any time during the turning movement, and shall continue to yield the right-of-way to the approaching vehicles until the left turn or U-turn can be made with reasonable safety.”

Fault and Liability

If Sullivan is determined to have been at fault, she could be held liable for the other driver’s injuries. On the other hand, if the other driver is at fault, he or she could be held liable for Sullivan’s serious injuries.
