Motorcyclist Injured in San Diego Car Accident

By

A man was seriously injured in a San Diego car accident involving a collision between a motorcycle and an SUV. According to a 10News report, the motorcycle crash occurred at Camino Del Rio North and Fairmount Avenue in San Diego, the morning of May 30, 2011. The report does not specify what caused the motorcycle and the SUV to crash into one another at the intersection. The man riding the motorcycle sustained serious injuries and was taken by ambulance to a nearby hospital. An investigation is ongoing.

My thoughts and prayers are with the injured victim of this San Diego motorcycle accident. I wish him a complete and speedy recovery from his injuries.

San Diego Motorcycle Accident Statistics

According to California Highway Patrol’s 2008 Statewide Integrated Traffic Records System (SWITRS), 16 people were killed and 355 were injured in San Diego motorcycle accidents. During that same year, 51 fatalities and 1,081 injuries occurred involving San Diego County motorcycle accidents.

What Caused This Crash?

The location where this injury accident occurred is a busy intersection monitored by traffic lights. It will have to be determined if one of the drivers failed to yield right-of-way, made an unsafe turn or ran a red light. California Vehicle Code Section 21453 (a) states: “A driver facing a circular red signal shall stop at the limit line before entering the crosswalk on the near side of the intersection or, if none, then before entering the intersection, and shall remain stopped until an indication to proceed is shown.”

According to California Vehicle Code Section 21800 (a): “The driver of a vehicle approaching an intersection shall yield the right-of-way to any vehicle which has entered the intersection from a different highway.”

Fault and Liability

If the driver of the SUV is determined to have been at fault, he or she could be held liable for the motorcyclist’s injuries. In such cases, injured victims can seek compensation for medical expenses, lost wages, cost of hospitalization, physical therapy and other damages. An experienced San Diego personal injury lawyer will be able to determine whether a dangerous condition on the roadway caused or contributed to the accident. If that was the case, the city or governmental agency could be held liable. Under California Government Code Section 911.2, any personal injury claim against a public entity must be filed within six months of the incident.
