Pedestrian Injured in Simi Valley Car Accident

A 57-year-old man was seriously injured in a Simi Valley car accident after he was struck by a vehicle while crossing the street. According to a news report in The Ventura County Star, the injury pedestrian accident happened at the intersection of Royal Avenue and Sycamore Drive, the night of August 18, 2011. Police are still looking into whether the man was in the crosswalk when the collision occurred. The pedestrian was transported to a local hospital with serious injuries. An investigation is ongoing.

Pedestrian Accident Statistics

According to California Highway patrol’s 2009 Statewide Integrated Traffic Records System (SWITRS), one person was killed and 23 were injured due to pedestrian accidents in Simi Valley. In Ventura County as a whole, 10 deaths and 196 injuries were reported involving pedestrian accidents, during the same year.

Crosswalk Law

Based on this news report, the pedestrian was struck as he crossed Royal Avenue. The intersection has clearly marked crosswalks and officials are trying to determine who had the light at the time and if the pedestrian was in the crosswalk. Motorists are required under the law to yield right-of-way to pedestrians walking in marked or unmarked crosswalks.

California Vehicle Code Section 21950 states: “The driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection.” The same section also states that the driver of a vehicle approaching a pedestrian within any marked or unmarked crosswalk “shall exercise all due care and shall reduce the speed of a vehicle or take any other action relating to the operating of the vehicle as necessary to safeguard the safety of the pedestrian.”
