Fullerton Car Accident Critically Injures Pedestrian

A woman was seriously injured in a Fullerton car accident after she was struck by a vehicle on Rosecrans Avenue, the evening of November 14, 2011. According to a news report in The Orange County Register, the major injury collision occurred on Rosecrans Avenue at Emery Ranch Road near Ralph B. Clark Regional Park. Officials say the pedestrian, a woman in her 30s, was hit by an SUV. The driver remained at the scene. The pedestrian sustained severe head trauma and was transported to an area hospital in critical condition. Officials are still investigating the cause of this crash.

My heart goes out to this pedestrian who has apparently suffered life-threatening injuries. I wish her the very best for a complete recovery. She will be in my thoughts and prayers.

Pedestrian Accidents in Orange County

According to California Highway Patrol’s 2009 Statewide Integrated Traffic Records System (SWITRS), one person died and 63 were injured due to pedestrian accidents in Fullerton. In Orange County as a whole, 41 fatalities and 864 injuries occurred due to pedestrian accidents, during the same year.

Pedestrians’ Rights

Based on this news report, it is unclear where the pedestrian was walking at the time. Officials are still looking into whether the victim was crossing Rosecrans at the intersection prior to the collision. Motorists are required under the law to yield the right of way to pedestrians who are walking in marked or unmarked crosswalks.

California Vehicle Code Section 21950 states: “The driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection.” The same section also states that the driver of a vehicle approaching a pedestrian within any marked or unmarked crosswalk “shall exercise all due care and shall reduce the speed of a vehicle or take any other action relating to the operating of the vehicle as necessary to safeguard the safety of the pedestrian.”
