San Diego Motorcycle Accident Proves Fatal

James Kelly Worley, 49, of Poway, was killed in a San Diego car accident when his motorcycle was hit by a vehicle, the morning of November 18, 2011. According to a 10News report, the fatal motorcycle accident occurred in the northbound lanes of the Interstate 5 in the Camp Pendleton area of San Diego. Officials say a 23-year-old Camp Pendleton man allowed his Nissan to drift into the motorcyclist’s path. Worley was pronounced dead at the scene of the crash. It is not clear if the driver of the Nissan will be cited for the collision.

San Diego Motorcycle Accident Statistics

According to California Highway Patrol’s 2009 Statewide Integrated Traffic Records System (SWITRS), nine people were killed and 291 were injured in San Diego motorcycle accidents. Countywide, there were 39 fatalities and 989 involving motorcycle accidents, during the same year.

What Caused This Fatal Car Accident?

It is not entirely clear what led to this collision. There are several unanswered questions here. Was the driver of the Nissan under the influence of alcohol? Was this motorist distracted, sleepy, inattentive, or speeding at the time?

Based on this news account, it appears the Nissan, whose driver made an unsafe lane change, cut off Worley. California Vehicle Code Section 21658 (a) states that whenever a roadway has been divided into two or more clearly marked lanes for traffic in one direction the vehicle “shall be driven as nearly as practical entirely within a single lane and shall not be moved from the lane until such movement can be made with reasonable safety.”

If the driver of the Nissan is determined to have been at fault, he can be held liable for fatal injuries suffered by the victim.     Very tragic. Worley, also know as “Jimbo”, was a sober member of AA and I just saw him give his girlfriend an 8 year token of sobriety. Jimbo glowed with love and care for his girlfriend and how beautiful life was for them. Pam is a wonderful woman as well…so full of life and enthusiasm. It is a tragic loss…but, Pam still showed up at a Friday night meeting because she knew that’s where her support is. What testimony of how AA helps thousands of people live a clean and sober life, regardless of the tragedies.
