Bicyclist Injured in San Diego Car Accident

By

A 23-year-old woman was severely injured in a San Diego car accident after a Hyundai SUV struck her bicycle. According to a news report in The San Diego Union Tribune, the bicycle accident occurred on College Avenue near Cresita Drive in San Diego, the evening of November 29, 2011. Officials say the 55-year-old driver of the SUV attempted to pass the bicyclist when there wasn’t enough room and his SUV clipped her bike. She suffered major facial fractures in the crash. It is not clear if the driver will be cited for the accident.

My thoughts and prayers are with the woman who has been seriously injured in this San Diego accident. I wish her the very best for a complete and speedy recovery.

San Diego Bicycle Accident Statistics

According to California Highway Patrol’s 2009 Statewide Integrated Traffic Records System (SWITRS), six people were killed and 525 were injured in San Diego bicycle accidents. Countywide, there were nine fatalities and 972 injuries reported due to bicycle accidents, during that same year.

What Caused This Injury Accident?

Based on this news report, it appears that the driver of the SUV made an unsafe lane change in an attempt to pass the bicyclist. California Vehicle Code Section 21658 (a) states that whenever a roadway has been divided into two or more clearly marked lanes for traffic in one direction the vehicle “shall be driven as nearly as practical entirely within a single lane and shall not be moved from the lane until such movement can be made with reasonable safety.”

Liability Issues

I trust officials are also determining if the driver of the SUV was impaired, speeding, driving recklessly, or negligent in any other way. If it is determined that this motorist was at fault, then, he can be held liable for the bicyclist’s injuries. Victims in such cases can seek compensation to cover medical bills, hospitalization, lost wages, and other related damages. Car accident victims would be well advised to contact an experienced San Diego personal injury lawyer, who will analyze all aspects of the incident and ensure that the negligent parties are held liable. The best personal injury law firms will always offer a free consultation and comprehensive case evaluation to accident victims and their families.
