Motorcyclist Injured in El Monte Car Accident

By

A 19-year-old man was seriously injured in an El Monte car accident after a vehicle exiting a driveway struck him, the afternoon of December 20, 2011. According to a news report in The San Gabriel Valley Tribune, the injury collision occurred on Ramona Boulevard near Penn Mar Avenue. El Monte police officials say the motorcycle was heading west on Ramona Boulevard when a vehicle pulled out of a driveway into Ramona and in front of the rider. The motorcyclist, who was wearing a helmet, was thrown off his bike and sustained major injuries. He was transported to an area hospital. The driver has not been cited pending an official investigation.

My heart goes out to this severely injured motorcyclist. I wish him the very best for a speedy and complete recovery. He will be in my thoughts and prayers.

Motorcycle Accident Statistics

According to California Highway Patrol’s 2009 Statewide Integrated Traffic Records System (SWITRS), one person was killed and 15 were injured in motorcycle accidents in El Monte. In Los Angeles County as a whole, 83 fatalities and 2,719 injuries were reported due to motorcycle accidents, during the same year.

Right-of-Way Issues

Based on this news report, the driver of the vehicle exited the driveway thereby failing to yield the right-of-way to the motorcycle. Drivers pulling out of public or private driveways must yield right-of-way to pedestrians and oncoming vehicles. According to California Vehicle Code Section 21804 (a): “The driver of any vehicle about to enter or cross a highway from any public or private property, or from an alley, shall yield the right-of-way to all traffic.” Vehicles entering traffic “shall continue to yield the right-of-way to that traffic until he or she can proceed with reasonable safety.”

Fault and Liability

If the driver is determined to have been at fault here, he or she could be held liable for the resulting injuries and damages. Injured victims can seek compensation to cover medical expenses, loss of wages and benefits, cost of hospitalization, rehabilitation, and other related damages. Motorcycle accident victims in such cases would be well advised to contact an experienced Los Angeles motorcycle accident lawyer, who will analyze all aspects of the incident and ensure that the negligent parties are held liable.
