Motorcyclist Seriously Injured in Laguna Niguel Car Accident

By

A motorcyclist suffered major injuries in a Laguna Niguel car accident, which occurred at a street intersection. According to a news report in The Orange County Register, the injury collision occurred the morning of March 7, 2012 at the intersection of Camino Capistrano and Avery Parkway. Officials say the motorcyclist was transported to an area hospital with severe injuries after striking another vehicle. They have not said what caused the accident or who was at fault. No one else was injured.

My thoughts and prayers are with the injured motorcyclist. I wish this injured victim the very best for a speedy and complete recovery.

Motorcycle Accident Statistics

According to California Highway Patrol’s 2009 Statewide Integrated Traffic Records System (SWITRS), there were no fatalities, but three injuries involving motorcycle accidents in Laguna Niguel. In Orange County as a whole, motorcycle accidents claimed 17 lives and injured 735 people, during the same year.

What Caused This Collision?

Based on this news report, it is unclear as to how or why this major injury motorcycle crash occurred. The intersection where this accident occurred is a T-intersection, which is regulated by traffic lights. It is not clear if the motorcyclist or the driver failed to yield the right-of-way here. Did one of the motorists run a red light? Did the driver of the other vehicle make an unsafe left turn?

According to California Vehicle Code Section 21800 (a): “The driver of a vehicle approaching an intersection shall yield the right-of-way to any vehicle which has entered the intersection from a different highway.”

Victims’ Claim for Compensation

If the driver of the other vehicle is determined to have been at fault, he or she can be held liable for the injuries caused to the motorcyclist. Victims in such cases can seek compensation to cover medical expenses, loss of wages, cost of hospitalization, rehabilitation and other related damages. Motorcycle accident victims would be well advised to seek the counsel of an experienced Orange County personal injury lawyer, who wills stay abreast of the official investigation and ensure that their legal rights and best interests are protected. The best personal injury law firms will always offer a free consultation and comprehensive case evaluation to injured victims and their families.
