Bicyclist Killed In Pomona DUI Collision

A bicyclist was fatally injured in what officials suspect was a collision caused by a drunk driver.

According to a KTLA news report, a BMW was traveling north on Garey Avenue near Philadelphia Street early morning on July 19, 2014 when it rear-ended a bicyclist who was in the right shoulder.

The man was thrown off his bike. He
died at a hospital later from his injuries. The driver left the scene.

But evidence collected at the scene led police to suspect the driver of the BMW, later identified as Rick Kyujin Lee, who they say was under the influence at the time of the crash.

He was arrested on suspicion of DUI causing death and vehicular manslaughter. The cause of the collision is under investigation. Anyone with information about this crash is asked to contact Pomona police at 909-620-2081.

Bicycle Accident Statistics

One person was killed and 64 were reported injured in bicycle collisions in Pomona, according to California Highway Patrol’s 2011 Statewide Integrated Traffic Records System (SWITRS).

In Los Angeles County as a whole, 30 people died and 4,758 were injured as a result of bicycle accidents during the same year.

Violation of Laws

Based on this news report, it appears that the driver of the BMW was under the influence when he rear-ended the bicyclist causing fatal injuries. In addition, officials say he left the scene of the crash.

According to California Vehicle Code Section 23152 (a): “It is unlawful for any person who is under the influence of any alcoholic beverage or drug, or under the combined influence of any alcoholic beverage and drug, to drive a vehicle.”

A driver whose act of driving under the influence results in the death of another will likely face vehicular manslaughter charges under California Penal Code section 191.5 (a).
