Man Fatally Injured In Santa Ana Car Accident

By

Roberto Rubio, 18, was killed in a Santa Ana car accident, which officials say, involved a suspected drunk driver.

According to a news report in the Orange County Register, the fatal crash occurred the night of October 25, 2014 at the intersection of South Bristol Street and Central Avenue.

Police say a suspected drunk driver in a Lexus
ran a red light at the intersection and broadsided a Honda car in which Rubio was a passenger.

Six Others Injured

The driver, identified as 23-year-old Herbert Calderon Granados, was arrested at the scene on suspicion of DUI. The crash left the Honda’s driver and two others trapped. Firefighters had to extricate them from the wreckage. All three men were taken to a local trauma center.

Four passengers in the Lexus were injured and taken to an area hospital. Two were said to be in serious condition while two others suffered relatively minor injuries. Police said the Lexus driven by Granados was traveling south on Bristol when it crashed with the Honda sending the car careening into a Chevy pickup truck. Police also said Granados was driving on a suspended license from a prior DUI conviction.

California DUI Laws

Based on this news report, officials say the driver in this case was not only under the influence at the time of the accident, but also ran a red light. In addition, he was driving with a license that was suspended for a previous drunk driving conviction.

Under California Vehicle Code Section 23152 (a), it is illegal to operate a vehicle under the influence of alcohol and or drugs. It is unclear if Granados will face vehicular manslaughter or a murder charge in connection with this incident.

Compensation for Injured Victims

In such cases, all injured victims can seek compensation for damages such as medical expenses, lost wages, hospitalization, rehabilitation, pain and suffering and emotional distress. Families that have lost loved ones in a DUI crash can seek compensation for damages by filing a wrongful death claim.

Injured victims and their families would be well advised to contact a knowledgeable Santa Ana personal injury lawyer who has experienced financially pursuing DUI drivers. A skilled attorney will also be able to advise victims regarding how their own insurance policies might apply to an incident where the at-fault driver is uninsured or underinsured.
