What Caused This Collision?
Based on this news report, it is unclear as to how or why this collision occurred. Under California Vehicle Code Section 21200, bicyclists have the same rights and responsibilities as drivers of other vehicles. There are several unanswered questions here.
Who had the right-of-way? How did this collision occur? Was it a rear-end accident? Was the bicyclist riding in a bike lane? Did excessive speed, distraction or inattentiveness cause this collision? Did a dangerous roadway condition cause or contribute to this accident?
We trust officials are looking into these and other issues in order to determine precisely what occurred here and why.

If the driver is determined to have been at fault, he can be held liable for the bicyclist’s injuries, damages and losses. If a dangerous roadway condition caused or contributed to the incident, the city or governmental agency responsible for maintaining the roadway can also be held liable.
Injured victims in such cases can seek compensation for damages including medical expenses, lost wages, hospitalization, rehabilitation, pain and suffering and emotional distress.
