Pedestrian Crash Statistics

There were two fatalities and nine injuries involving pedestrian accidents in the city of Highland, according to California Highway Patrol’s 2012 Statewide Integrated Traffic Records System (SWITRS).

In San Bernardino County as a whole, 45 people died and 393 were injured due to pedestrian accidents in 2012.

Laws Relating to Pedestrians

Based on this news report, it appears that the driver did not see the pedestrian on the roadway in time to avoid the collision.

California Vehicle Code Section 21954 states: “Every pedestrian upon a roadway at any point other than within a marked crosswalk or within an unmarked crosswalk at an intersection shall yield the right-of-way to all vehicles upon the roadway so near as to constitute an immediate hazard.”

The same section also states: “The provisions of this section shall not relieve the driver of a vehicle from the duty to exercise due care for the safety of any pedestrian upon a roadway.”

The Importance of Eyewitnesses

In any type of auto accident, the testimony of an impartial eyewitness can bear significant weight. This is why it is important for victims of accidents to gather contact information for anyone who may have witnessed the accident.

If you have been seriously injured, it would be helpful if a family member or friend is at the scene to gather such evidence for you.

In this particular case, an eyewitness can help determine important details such as:

• Who had the right-of-way?
• Was the pedestrian walking in the crosswalk?
• How fast was the motorist traveling?
• Was the driver talking on a cell phone or texting at the time?
• Did the driver attempt to stop when he saw the pedestrian?

Injured pedestrian accident victims can seek compensation for damages including medical expenses, lost wages, hospitalization, rehabilitation, pain and suffering and emotional distress.

An experienced San Bernardino personal injury lawyer can help victims in such cases obtain fair and full compensation for all their significant losses.
