Bicyclist Suffers Critical Head Injury In Huntington Beach Crash

AccidentA bicyclist was critically injured in a Huntington Beach car accident the evening of October 13, 2015.

According to a news report in the Huntington Beach Independent, the cyclist was riding east in the bike lane on Warner Avenue just east of Springdale Street when a Toyota Prius veered into the bike lane and struck the bicyclist from behind.

The cyclist suffered a head injury and was transported to an area hospital.

The driver remained at the scene and officials say it doesn’t appear that alcohol or drugs were involved.

The investigation is ongoing.

Bicycle Accident Statistics

There were no fatalities, but 172 injuries reported as a result of bicycle accidents in Huntington Beach, according to California Highway Patrol’s 2013 Statewide Integrated Traffic Records System (SWITRS).

In Orange County as a whole, nine people died and 1,309 were injured due to bicycle accidents during the same year.

Laws and Liability Issues

Based on this news report, it appears that the driver of the Toyota Prius violated the law by veering into the bike lane and rear-ending the bicyclist.

According to California Vehicle Code Section 21209 (a), motorists are not allowed to drive a motor vehicle in a bicycle lane established on a roadway. The only exceptions are when a driver parks where parking is permitted, enters or leaves the roadway or prepares for a turn within 200 feet of the intersection.

If the driver is determined to have been at fault, then, he or she can be held liable for the injuries, damages and losses. Injured victims in such cases can seek compensation for damages including medical expenses, lost wages, hospitalization, rehabilitation, permanent injuries, pain and suffering and emotional distress.
