Man Arrested in Fatal Fountain Valley Bicycle Accident

By

Police arrested a man hours after a car struck and killed 41-year-old Binh Ngo who was riding his bicycle at the time. According to a news report in The Orange County Register, the collision occurred during the early morning hours of September 13, 2017, at the intersection of Brookhurst Street and Ellis Avenue. Police who responded to the scene said they found the bicyclist, Ngo, dead at the scene. The driver had fled.

Tip from the Public

Surveillance video showed Ngo was struck by an older-model red Ford Mustang. Police ended up arresting 25-year-old Justin German of Huntington Beach in connection with the hit-and-run crash. The arrest came after a tip from a person who, based on news reports, spotted the damaged vehicle. German was arrested on suspicion of felony hit and run. His vehicle was towed and stored for evidence. Police say additional charges are pending and that the investigation is ongoing. Anyone who witnessed this incident is urged to call Fountain Valley police at 714-593-4481.

We offer our heartfelt condolences to the family members and friends of Binh Ngo for their tragic loss. Please keep them in your thoughts and prayers.

Leaving the Scene of a Crash

Based on this news report, it is unclear as to how this collision occurred. However, it appears that the driver not only struck and fatally injured the bicyclist, but also left the scene of the crash without stopping to help the victim. Under California law, it is a felony crime to leave the scene of an injury or fatal traffic accident.

California Vehicle Code 20001 (a) states: “The driver of a vehicle involved in an accident resulting in injury to a person, other than himself or herself, or in the death of a person shall immediately stop the vehicle at the scene of the accident.” We are relieved that officials were able to receive tips from the public, which helped them apprehend the hit-and-run driver.

Potential Wrongful Death Claim

In such cases where negligence or wrongdoing may have been a factor, families of deceased accident victims may be able to file a wrongful death lawsuit seeking compensation for damages including medical expenses, funeral costs, lost future income, pain and suffering and loss of love and companionship.
