An elderly woman was struck and injured in a pedestrian accident in Arcadia, which officials say, involved a suspected hit-and-run driver. According to a news report in the San Gabriel Valley Tribune, the collision took place the night of December 14, 2016 on Baldwin Avenue at Arcadia Avenue. The woman was crossing Baldwin Avenue when a northbound Ford Explorer Sport Trac pickup truck struck her.
The truck continued driving. But, multiple witnesses called 911 to report the crash and provide information including the license plate number of the hit-and-run pickup truck. Pasadena police located and arrested the suspected driver a short time later at his home. The woman was hospitalized in critical condition, but is said to be stable now. The investigation is still ongoing.
Our thoughts and prayers go out to the critically injured pedestrian. We wish her the very best for a speedy and complete recovery.
There were three fatalities and 17 injuries as a result of pedestrian accidents in the city of Arcadia in 2013, according to California Highway Patrol’s Statewide Integrated Traffic Records System (SWITRS). In Los Angeles County as a whole, 211 people were killed and 4,721 were injured due to pedestrian accidents during the same year.
Laws and Liability Issues
Based on this news report, it appears that the driver not only struck and injured the pedestrian at a street intersection, but that he left the scene without even stopping to assist the elderly victim. California Vehicle Code 20001 (a) states: “The driver of a vehicle involved in an accident resulting in injury to a person, other than himself or herself, or in the death of a person shall immediately stop the vehicle at the scene of the accident.”
In such cases, the at-fault driver can be held for injuries, damages and losses to the victim. Injured victims can seek compensation for damages such as medical expenses, lost income, hospitalization, permanent injuries, pain and suffering and emotional distress.
An experienced Los Angeles pedestrian accident lawyer will be able to advise victims about their legal rights and explain how their own auto insurance policy might apply to an incident where the at-fault driver is uninsured or underinsured. A knowledgeable injury attorney will also be able to determine whether a dangerous or defective condition in the roadway caused or contributed to the incident. If that was the case, the city or governmental agency responsible for maintaining the roadway can also be held responsible.
