Bicyclist Critically Injured in Oxnard Car Accident

Robert Escobar, 55, was injured in an Oxnard car accident, which officials say, involved a suspected drunk driver. According to a news report in The Ventura County Star, the major injury bicycle collision occurred on Victoria Avenue the night of July 14, 2012. Officials say Escobar was riding his bike north on Victoria Avenue when he was struck by a vehicle driven by 36-year-old Kris Helms. Escobar was transported to an area hospital where he underwent surgery and remains in critical condition. His daughter, Angela Escobar, says her father is in a coma with broken ribs, a collapsed lung, facial injuries and possible brain damage. Helms has been arrested on suspicion of driving under the influence.

My thoughts and prayers go out to Robert Escobar and his family for what they are going through at this time. His daughter says that Escobar, an avid bike rider, is the sole provider for his son and wide. I wish him the very best for a quick and full recovery.

Laws and Liability Issues
Based on this news report, officials say the driver who struck Escobar was under the influence at the time. Under California law, it is illegal to operate a motor vehicle under the influence of alcohol and/or drugs. According to California Vehicle Code Section 23152 (a): “It is unlawful for any person who is under the influence of any alcoholic beverage or drug, or under the combined influence of any alcoholic beverage and drug, to drive a vehicle.”
DUI drivers, in addition to facing criminal charges, can also be held financially responsible for the injuries and damages caused. Injured victims in such cases can seek compensation to cover medical expenses, loss of wages, cost of hospitalization, rehabilitation, lost future income and pain and suffering. Victims would also be well advised to contact an experienced Ventura County personal injury lawyer who has a successful track record of financially pursuing DUI drivers.
