Two Injured in Car Accident Near Orange County School

Two people were injured in a car accident in Orange County which officials say involved three vehicles. According to a news report in The Orange County Register, the injury car accident occurred the morning of February 4, 2011 at the intersection of Newland Street and Trask Avenue in Westminster near Iva Meairs Elementary School. Officials say the car accident involved a Jeep Cherokee Laredo, a Ford Expedition and a Lexus ES 330. Both victims were transported to area hospitals for treatment. The extent of their injuries is not known at this time.

I sympathize with the injured victims of this car accident. I wish them the very best for a quick and full recovery. Please keep them in your prayers. It is indeed fortunate that no school children were hurt as the accident seems to have happened right before the start of the school day.

Car Accident Statistics

According to California Highway Patrol’s 2008 Statewide Integrated Traffic Records System (SWITRS), there were four fatalities and 467 injuries involving Westminster car accidents. In Orange County as a whole, 152 people died and 13,414 were injured in car accidents during the same year.

Right-of-Way Issues

Based on this news report, officials are still looking into what led to this injury car accident. The intersection of Newland Street and Trask Avenue in Westminster is a major and busy intersection, which is monitored by traffic signals. It is unclear whether one of the drivers failed to yield right-of-way or ran a red light at the intersection, causing this injury accident.

According to California Vehicle Code Section 21800 (a): “The driver of a vehicle approaching an intersection shall yield the right-of-way to any vehicle which has entered the intersection from a different highway.” Running a red light is also a serious traffic violation under California Vehicle Code Section 21453 (a). I trust officials are also looking into whether driver distraction, impairment or speed were factors in this case.

Fault and Liability

The at-fault driver in these types of car accidents can be held financially responsible for the resulting injuries, damages and losses. Car accident victims can seek compensation for medical costs, hospital expenses, lost wages, pain and suffering, and related damages. In a multi-vehicle car accident, injured victims would be well-advised to seek the guidance of an experienced Orange County personal injury lawyer. These investigations often involve multiple victims, witnesses, insurance companies and other lawyers, and can get very complex. It would be in victims’ best interests not to talk to insurance adjusters or sign agreements before getting the advise of a knowledgeable injury lawyer.
