Lee Neang, 69, of Buena Park, died in a Cypress three-car traffic collision on October 3, 2008, near Walker Street. According to a news report in The Orange County Register, Amika Sergejev, 30, who reportedly caused the accident, is expected to be charged with vehicular manslaughter. The fatal accident occurred 10/3/2008 when Sergejev, who was driving a truck on Lincoln Avenue, crashed into Neang’s car and caused Neang to hit a third vehicle, injuring its occupant.
Our hearts go out to the family of Lee Neang for their tragic loss. I offer my deepest condolences to them.
According to California Highway Patrol’s Statewide Integrated Traffic Reporting System, in 2006, there were three fatal traffic collisions and 155 auto accidents causing injuries in Cypress. In Orange County, there were a total of 199 fatal collisions in 2006 and 14,981 traffic accident related deaths.
Sergejev’s actions have resulted in an irreparable loss to Neang’s family and they deserve to be rightfully compensated. If I were handling this case for the Neang family I’d begin by determining what caused this Cypress car accident? Was Sergejev under the influence of alcohol and/or drugs or was she a distracted driver at the time of causing the 10-3-2008 crash? I’m sure traffic investigators are piecing all this information together. The fact that they expect to file vehicular manslaughter charges against Sergejev definitely points to her as the party at fault.
California’s Penal Code Section 192 (c) defines vehicular manslaughter as “driving a vehicle in the commission of an unlawful act, not amounting to felony, and with gross negligence; or driving a vehicle in the commission of a lawful act which might produce death, in an unlawful manner, and with gross negligence.”
The family of Lee Neang will be well advised to retain the services of an experienced Orange County auto accident attorney who will make sure that is the party or parties responsible for his death are held accountable for it. A skilled personal injury lawyer will also examine the Cypress roadway or intersection to see if there was a dangerous condition there. If it is determined that a dangerous roadway or intersection was a factor in this crash, then the government agency responsible for maintaining that roadway could be held liable.
