A woman who was injured in a hit-and-run car accident the night of October 9, 2010, has been identified as 22-year-old Danielle Kommemi. According to an ABC News report, the car accident occurred near the intersection of Avenida De Las Arboles and Arcturus Street in Thousand Oaks. Kommemi suffered non-life-threatening injuries. But the driver who hit her, identified as Maples, abandoned the car he was in and ran away from the scene. However, police caught up with him and arrested Maples on suspicion of drunk driving and hit-and-run.
It is indeed fortunate that Kommemi did not suffer major injuries in this Ventura car accident. I pray that she recovers quickly and completely from the injuries she has sustained.
Car Accident Statistics
There were 63 fatalities and 3,785 injuries involving car accidents in Ventura County, according to California Highway Patrol’s 2008 Statewide Integrated Traffic Records System (SWITRS). Also, countywide, 27 fatalities and 475 injuries were reported as a result of DUI collisions during the same year.
Laws and Liability Issues
Not only is it illegal to drive a motor vehicle under the influence of alcohol or drugs, but it is also a crime to leave the scene of an injury accident. California Vehicle Code Section 20001 (a) states: “The driver of a vehicle involved in an accident resulting in injury to a person, other than himself or herself, or in the death of a person shall immediately stop the vehicle at the scene of the accident.”
Motorists are required to remain at the scene, provide information to the other parties and also obtain help for the injured victim. It is appalling that Maples not only drove under the influence, but also crashed his car and left an injured victim at the scene. I’m relieved that this individual was apprehended and taken off the street.
Injured victims in such cases would be well-advised to see the counsel of a reputed Ventura personal injury lawyer, who has the experience and a successful track record holding drunk and negligent drivers financially responsible. A knowledgeable car accident lawyer will also be able to advise victims about how their car insurance policies might apply to an incident where the at-fault driver is uninsured or underinsured.
