Ex-Dodger CEO’s Driver Involved in Los Angeles Car Accident

A pedestrian was seriously injured in a Los Angeles car accident involving the driver of Los Angeles Dodgers’ co-owner, Jamie McCourt. According to an Associated Press news report, the injury collision occurred the morning of September 20, 2010, when McCourt’s driver was bringing her to testify in her much-talked-about divorce case, and backed into the female pedestrian. Officials say the 2010 Land Rover struck the woman who was walking in a marked crosswalk outside the downtown Los Angeles courthouse. The injured victim was transported to a local hospital with apparent neck injuries.

My heart goes out to this pedestrian who was injured in this accident. I wish her the very best for a speedy and complete recovery.

Pedestrian Accident Statistics

According to California Highway Patrol’s 2008 Statewide Integrated Traffic Records System (SWITRS), 104 people were killed and 2,716 people were injured in Los Angeles pedestrian accidents. In Los Angeles County, 214 fatalities and 4,985 injuries were reported as a result of pedestrian accidents in 2008.

California Crosswalk Law

It is unclear from this report exactly how this pedestrian accident occurred. Commenters to the Associated Press article have posted that the vehicle stopped at a red light and then backed up into the female pedestrian who had walked behind the vehicle in the crosswalk. California Vehicle Code Section 21950 states: “The driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection.” The same section also states that the driver of a vehicle approaching a pedestrian within any marked or unmarked crosswalk “shall exercise all due care and shall reduce the speed of a vehicle or take any other action relating to the operating of the vehicle as necessary to safeguard the safety of the pedestrian.”

Liability Issues

In this case, if McCourt’s driver is determined to have been at fault, then he and his employer could be held liable for the pedestrian’s injuries as the driver was on-the-job at the time. Injured victims in such cases could seek compensation to cover medical expenses, lost wages, cost of hospitalization, physical therapy and other related damages. It would be in the best interests of injured victims to seek the counsel of an experienced Los Angeles personal injury lawyer, who will stay on top of the official investigation and ensure that their legal rights are protected.

What are some precautions you would take as a pedestrian while walking in a crosswalk?
