A 31-year-old man was killed in a Los Angeles car accident, which officials say, involved a suspected drunk driver. According to a report in The Pasadena Star-News, the fatal car accident occurred early morning on December 2, 2010 on the 210 Freeway near Lake Avenue in Pasadena.
California Highway Patrol officials say 24-year-old David Peng was driving a BMW M3 and crashed into a Honda driven by the victim. The man, whose name has not yet been released, was pronounced dead at the scene. The Honda had apparently crashed into the center divider and was disabled when the BMW slammed into it, splitting it in two. Peng was arrested on suspicion of DUI and vehicular manslaughter.

According to CHP’s 2008 Statewide Integrated Traffic Records System (SWITRS), there were two fatalities and 59 injuries involving DUI collisions in Pasadena. In Los Angeles County as a whole, 258 people died and 4,832 were injured as a result of alcohol-related car accidents in 2008.
Drunk Driving Laws
Based on this news report, officials do not know why the initial accident involving the Honda occurred. But they say Peng crashed into the Honda because he was intoxicated at the time. Driving under the influence of alcohol and/or drugs is a serious crime under California law.
According to California Vehicle Code Section 23152 (a): “It is unlawful for any person who is under the influence of any alcoholic beverage or drug, or under the combined influence of any alcoholic beverage and drug, to drive a vehicle.” A driver whose act of driving under the influence results in the death of another will likely face vehicular manslaughter charges under California Penal Code section 191.5 (a), as Peng does in this case.
