Based on this news report, Gonsalez lost control of his Ford Explorer SUV. Was this accident caused by a design defect in the Ford Explorer SUV or some other auto defect in Gonsalez’s vehicle? According to The Insurance Institute for Highway Safety (IIHS), pickups and SUVs are more likely than cars to be in fatal single-vehicle crashes, especially rollovers. In the year 2009, 2,384 people were killed in SUV rollover accidents throughout the United States. Based on crash tests performed by our own firm, we have found that Ford SUVs especially the Explorer is prone to tipping over even at normal speed.
If it is determined that an auto defect or design defect led to this accident, then the victim’s family can file a wrongful death lawsuit against the auto maker seeking damages. The victim’s family in such cases can seek compensation for medical and funeral expenses, lost future wages, loss of love and companionship, and other related damages. It would be in the family’s best interests to preserve the SUV in its current condition, intact, so it can be thoroughly examined by an expert for evidence of vehicle defects, design flaws or malfunctions.
