Daniel Tejada, 49, was killed in a San Bernardino car accident on October 31, 2010 after he was struck by a driver who fled the scene. According to a news report in The San Bernardino Sun, Tejada was at the intersection of Linn Road and Sage Avenue in Landers when he was hit. Tejada died from his injuries at the accident site. The driver initially fled the scene, but was arrested shortly after the pedestrian accident. An investigation is ongoing.
I offer my deepest condolences to the family and friends of Daniel Tejada for their tragic and devastating loss. Please keep them in your thoughts and prayers.
Pedestrian Accident Statistics
According to California Highway Patrol’s 2008 Statewide Integrated Traffic Records System (SWITRS), there were five fatalities and 64 injuries involving pedestrian accidents in the unincorporated areas of San Bernardino County. Also, countywide, 39 people died and 432 were injured as a result of pedestrian accidents during the same year.
Laws Relating to Pedestrians
Based on this news report, it appears that the pedestrian was walking at the intersection. It also seems that the driver may have failed to yield right-of-way to the pedestrian. California law requires motorists to yield right-of-way to pedestrians walking in marked or unmarked crosswalks.
California Vehicle Code Section 21950 states: “The driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection.” The same section also states that the driver of a vehicle approaching a pedestrian within any marked or unmarked crosswalk “shall exercise all due care and shall reduce the speed of a vehicle or take any other action relating to the operating of the vehicle as necessary to safeguard the safety of the pedestrian.”
Hit-and-Run and Liability Issues
In this case, the driver also left the scene of a fatal pedestrian accident, which is a serious crime under California Vehicle Code Section 20001 (a). I’m relieved to hear that officials have apprehended this hit-and-run driver. I think it is absolutely outrageous that this motorist chose to flee after striking and injuring Tejada! It is entirely possible the victim may have had a fighting chance to live had he received timely medical aid. I sincerely hope this driver will be prosecuted to the fullest extent of the law.
