Fatal San Bernardino Rollover Accident

Alex Rocha, 11, was killed in a San Bernardino car accident after the vehicle in which he was a passenger rolled over and crashed. According to a news report in The San Bernardino County Sun, the fatal rollover accident occurred on Highway 95 near Highway 62, the morning of June 6, 2011. The driver of the vehicle veered off the northbound 95 and then attempted to steer back onto the roadway. This caused the vehicle to roll over. Alex died at the scene of the crash. His mother and sisters also sustained injuries in this accident. California Highway Patrol officials are investigating the cause of this car accident.

I offer my deepest condolences to the family members and friends of Alex Rocha for their devastating loss. My heart also goes out to the injured victims of this rollover accident. Please keep the Rocha family in your thoughts and prayers.

Car Accident Statistics

According to CHP’s 2008 Statewide Integrated Traffic Records System (SWITRS), there were 107 fatalities and 1,925 injuries involving car accidents in the unincorporated areas of San Bernardino County. Also, countywide, 263 people died and 8,504 were injured as a result of car accidents during the same year.

What Caused This Rollover Crash?

Based on this news report, there are a number of questions about this rollover crash. It is not known what type of vehicle the family was in at the time. Who was driving the vehicle? What caused the vehicle to go off the roadway? Was there an auto defect or mechanical malfunction in the vehicle? Was the vehicle run off the road by another car? Was there a dangerous condition on the roadway, which may have caused or contributed to the incident? Was there a design defect in the vehicle, which caused it to roll over when the driver overcorrected? I trust officials are looking into these and other issues in order to determine precisely what occurred here.

Fault and Liability

If it is determined that an auto defect or vehicle design flaw caused this incident, then, the family can file an auto products liability and wrongful death lawsuit against the auto maker. If a dangerous roadway caused the accident, then, the governmental agency responsible for maintaining the roadway can also be held liable. The vehicle in such cases should be preserved so an expert can examine it thoroughly for product defects, malfunctions, design issues and other evidence.
