Man Killed in Westminster Car Crash


Joey Nungaray, 27, was killed in a Westminster car accident, which officials say, involved a suspected drunk driver. According to a news report in The Orange County Register, the fatal collision occurred at the intersection Brookhurst Street and McFadden Avenue. Police say a Nissan Frontier truck, which was traveling south, broadsided a Honda Civic that was westbound. Investigators say one of the vehicles ran a red light, but have not determined which driver committed the violation.

Nungaray, the driver of the Honda, died from his injuries. The driver of the Nissan pickup truck, Emmanuel Garibay, was arrested and booked on suspicion of driving under the influence. Anyone with information about the crash is asked to contact the Westminster Police Department at 714-898-3315.

Crash Statistics

According to California Highway Patrol’s 2010 Statewide Integrated Traffic Records System (SWITRS), there were eight fatalities and 432 injuries involving traffic accidents in the city of Westminster. Of those, one fatality and 29 injuries occurred as a result of alcohol-related collisions. In Orange County as a whole, 45 fatalities and 1,317 injuries were reported as a result of DUI crashes.

Violation of Laws

Based on this news report, it appears that one of the drivers was under the influence at the time of the crash. According to California Vehicle Code Section 23152 (a): “It is unlawful for any person who is under the influence of any alcoholic beverage or drug, or under the combined influence of any alcoholic beverage and drug, to drive a vehicle.” It also appears that one of the drivers ran a red light causing the crash. Officials are still trying to determine which one of the drivers had the green light at the time and who ran the red light.
