Fresno Car Accident Kills Motorcyclist

Steven Hill, 47, was killed in a Fresno car accident after his motorcycle collided with a 2003 Chevrolet at a local intersection. According to a news report in The Fresno Bee, the fatal accident occurred the night of October 2, 2010 at the intersection of Jensen and Valentine Avenues. Hill was riding his 2006 Harley Davidson motorcycle north on Valentine when he stopped at a stop sign. He then entered into the path of a Chevrolet, as he crossed Jensen. Officials say the driver of the Chevrolet appeared to have the right-of-way at the time. Hill died at the scene. The driver of the Chevrolet, 30-year-old Juan Jose Fernandez, sustained minor injuries. An investigation is ongoing.

I offer my deepest condolences to the family and friends of Steven Hill for their tragic and heartbreaking loss. It is indeed fortunate that Fernandez was not seriously hurt in this crash. My thoughts and prayers are with Hill’s family during this difficult time.

Fresno Motorcycle Accidents

According to California Highway Patrol’s 2008 Statewide Integrated Traffic Records System (SWITRS), seven people were killed and 79 were injured in Fresno motorcycle accidents. During that same year, 14 fatalities and 206 injuries were reported as a result of motorcycle accidents in Fresno County.

What Caused This Tragic Accident?

If this news report is accurate, officials believe the motorcyclist, Hill, should have stopped and yielded right-of-way to the other vehicle. It does appear that Hill stopped initially at the stop sign, but proceeded to ride into the intersection. Was this a dangerous intersection? Was Hill unable to see the approaching vehicle for some reason? I trust officials are also looking into whether other factors such as impairment, distraction or reckless driving played a part in this fatal car accident.

Liability Issues

If Fernandez is determined to have been at fault, then he could be held liable for Hill’s wrongful death. If a dangerous condition on the roadway caused or contributed to this crash, the city or governmental agency responsible for maintaining this roadway can also be held liable. Please remember that any personal injury or wrongful death claim against a public entity must be filed within 180 days of the accident or injury, under California Government Code Section 911.2. An experienced Fresno personal injury lawyer will be able better advise victims or their families about their legal rights and options.
