Hesperia Bicycle Accident Leaves One Dead

A 57-year-old bicyclist, who was struck and killed by a Chevy Suburban the evening of November 2, 2008, has been identified as Miguel Garcia of Hesperia. The fatal San Bernardino County bicycle accident occurred while Miguel Garcia was crossing Main Street east of I Street in Hesperia, according to a news report in the Riverside Press-Enterprise.

According to another news report in the Victorville Daily Press, Garcia was traveling eastbound in the number one lane between I Street and Peach Avenue when he was hit by the Suburban, which was also traveling eastbound. Initial accident reports state that the driver of the Suburban was “not speeding or driving erratically.” Garcia was pronounced dead at the scene. The driver of the Suburban has not been arrested or cited pending an investigation.

According to California Highway Patrol’s Statewide Integrated Traffic Reporting System (SWITRS), there was one bicycle accident fatality in the City of Hesperia in 2006 and five bicycle accident related injuries. In San Bernardino County as a whole, 11 deaths and 270 injuries were reported as a result of bicycle accidents during the same period.

I offer my condolence to the family of Miguel Garcia for their tremendous loss. Please keep them in your prayers.

The news reports are not very clear on how exactly this accident occurred other than stating that both the bicycle and the SUV were traveling in the same direction. Initial traffic investigation reports state that speed was not a factor and that the driver was not being erratic. If that’s accurate, what caused this 11/2/08 bicycle accident?

If I were a member of Miguel Garcia’s family, I would want to find out the truth. Who caused those fatal injuries and who should be held responsible for it? I’d urge the family of Miguel Garcia to consult a skilled California bicycle accident attorney who will be able to get to the bottom of this and determine who or what is responsible for this tragic accident.

An experienced California personal injury lawyer will also be able to look at other factors that may have caused this accident such as a dangerous roadway. Was there a roadway condition that hampered the SUV driver’s visibility or prevented him or her from seeing the bicyclist on the road? If roadway conditions played a role in this accident then the city of Hesperia could be held liable. Please remember that any claim against a government agency must be filed within six months of an accident.
