Horrific San Diego Hit-and-Run Crash Involves Suspected DUI Driver

A man was killed in a horrific hit-and-run crash in Oceanside, which involved a driver who police say was under the influence. According to a news report on NBC San Diego, the crash occurred in the early morning on June 27, 2016 in the 4000 block of Mission Avenue. Witnesses said a man who was walking on the sidewalk was struck by the car, which officials later determined was being driven by 29-year-old Esteysi Sanchez Izazaga.

Police said because of how fast Izazaga was driving, the victim flew into the windshield head down coming to rest on the front passenger seat. The man’s leg detached from his body and flew through the back window landing on the truck of the car. Izazaga continued driving for about a mile. She then parked the vehicle and walked away before officers arrived at the scene. Shortly after she abandoned her car, her boyfriend called the police and reported the incident. She was arrested and charged with felony DUI, hit-and-run and vehicular manslaughter.

Our heartfelt condolences go out to the family of the deceased victim. Please keep them in your thoughts and prayers.

Violation of Laws

Based on this news report, this incident played out like a scene in a horror movie. Not only do officials believe that the driver in this case was under the influence, but they also say she struck the man and then drove with his body in the car for about a mile before abandoning the vehicle and walking away. Driving a vehicle under the influence of alcohol and/or drugs is a serious crime under California Vehicle Code Section 23152 (a). It is also against California Vehicle Code Section 20001 (a) to leave the scene of a fatal or injury crash.

Liability Issues

In such cases, in addition to facing criminal charges, DUI drivers can also be held financially responsible for the victim’s wrongful death. In cases where negligence or wrongdoing is involved, families of deceased victims can file a wrongful death claim seeking compensation for damages such as medical and funeral costs, lost future income, pain and suffering and loss of love and companionship. An experienced San Diego personal injury lawyer who has successfully handled such claims on behalf of DUI victims’ families will be able to help seek and obtain justice for injured victims or their families.
