Car Accident Statistics
According to California Highway Patrol’s 2008 Statewide Integrated Traffic Records System (SWITRS), there were 268 fatalities and 25,588 injuries involving Los Angeles car accidents. In Los Angeles County as a whole, 667 people died and 52,229 were injured as a result of car accidents during the same year.
Possible Accident Causes
Based on this news report, it is not quite clear how or why this bus accident occurred. There are several questions here that have not been answered. Was the bus driver at fault? Was one of the other vehicles responsible? Was driver distraction a factor in this car accident? Was one of the drivers under the influence of alcohol and/or drugs? Did one of the drivers fail to yield right-of-way at the intersection or run a red light?
According to California Vehicle Code Section 21800 (a): “The driver of a vehicle approaching an intersection shall yield the right-of-way to any vehicle which has entered the intersection from a different highway.” Failing to stop for a red light is also a serious violation under California Vehicle Code Section 21453.
Fault and Liability
If the bus driver is at fault, then he or she could be held liable for the accident and injuries caused. If the driver of one of the other vehicles is determined to have been at fault, then that individual could be held financially responsible for the injuries and damages caused. Injured victims in such cases can seek compensation for medical expenses, loss of wages, hospitalization, medication and therapy costs.
