Woman Killed in Los Angeles Car Accident

Teresa Andrade, 71, was killed in a Los Angeles car accident the afternoon of December 20, 2009, after a fleeing hit-and-run driver struck her car. According to a news report in the Los Angeles Times, Andrade was ejected from her car when an SUV struck it on Wilmington Avenue near Raymond Street, in Compton. The SUV was going north on Wilmington when it struck a woman on a motorcycle who was traveling in the same direction. The driver of the SUV slowed down as if he were going to stop or pull over but instead made a U-turn and crashed into the vehicle carrying Andrade.

The driver fled the site of the crash, but his SUV’s license plate had fallen off at the scene. Los Angeles Sheriff’s officials traced the license plate to a Compton home where they detained three people. However, the driver was brought in to the Compton police station by family members shortly after the accident. Officials have not yet identified the driver.

I offer my deepest condolences to the family and friends of Teresa Andrade for their tragic and heartbreaking loss. Please keep them in your prayers.

Los Angeles Car Accidents

According to California Highway Patrol’s 2007 Statewide Integrated Traffic Records System (SWITRS), there were nine fatalities and 359 injuries involving car accidents in Compton, California. In Los Angeles County as a whole, 712 deaths and 56,475 injuries were reported as a result of car accidents in 2007.

Hit-and-Run Law

Based on this news report, it appears that the driver of the SUV was behaving in a reckless manner. It is not clear whether he was impaired, distracted, speeding or simply driving recklessly. His age is also not clear. We do not know if he is a juvenile or whether he even had a driver’s license. So, there are several unanswered questions here. It is a serious crime to leave the scene of an accident. According to California Vehicle Code section 20001: “The driver of a vehicle involved in an accident resulting in injury to a person, other than himself or herself, or in the death of a person shall immediately stop the vehicle at the scene of the accident.

Claim for Compensation

Andrade’s family would be well-advised to retain the services of a reputed Los Angeles personal injury lawyer, who has an excellent track record of pursuing negligent drivers and holding them accountable. A knowledgeable car accident lawyer can also advise victims about how their car insurance policy or any auto insurance policy they have benefits under, will apply to a hit-and-run accident or an incident involving an uninsured or underinsured driver.

The article also says Andrade was ejected from the vehicle. I would look into whether she was buckled up at the time of the accident. If she was, the question arises as to whether she was ejected as a result of a seatbelt defect or a seat restraint system failure.
