Five people — John J. Blackburn, 54, Luis Villegas, 16, Xochitl Hernandez, 5, Edgar Hernandez, 8, and Cynthia Hernandez, 9 — were killed in a Los Angeles car accident the night of April 11, 2010. According to a news report in the Los Angeles Times, the three-vehicle accident occurred in the southbound lanes of the 5 Freeway in Newhall. The chain of events began when Blackburn, who was driving a 1996 Mazda pickup, veered into the center divider. A Nissan Altima with six occupants, including three children, had been following the Mazda and was unable to avoid hitting the pickup, which had overturned. A Chevy Suburban then, struck the Nissan from behind.
Tragic Car Accident Kills Four Children
Xochitl, Edgar and Cynthia, who were siblings, died. Luis, who was riding in the back seat of the Nissan was also killed as was Blackburn. The driver of the Nissan, 25-year-old Francisco J. Enciso and his passenger, 27-year-old Yessica Milan, were both seriously injured. The driver of the Suburban, Victor Jarillo, was arrested on suspicion of driving without a license and his passenger was also arrested on suspicion of providing false information to police. An investigation into the cause of the crash is ongoing.
I offer my deepest condolences to the family and friends of everyone who was killed in this horrific crash. What a devastating blow for the families of the children involved in this collision! Heartbreaking! I also wish the injured victims the very best for a speedy and complete recovery. Please keep these victims and their families in your thoughts and prayers.
Car Accidents in Los Angeles
According to California Highway Patrol’s 2008 Statewide Integrated Traffic Records System, (SWITRS), 268 deaths and 25,588 injuries were reported in Los Angeles as a result of car accidents. Countywide, 667 fatalities and 52,229 injuries were reported as a result of car accidents in 2008.
Based on this news report, it is not exactly clear who or what caused this car crash. If Jarillo is determined to have caused the fatal injuries, he could be held criminally and civilly liable in this case. I trust CHP officials are in the process of sifting through the physical evidence and eyewitness testimony in order to determine precisely what happened here.
In such cases, injured victims and families of deceased victims would be well-advised to contact an experienced Los Angeles personal injury lawyer who will stay abreast of the official investigation and ensure that their legal rights and best interests are protected. In cases where negligence or wrongdoing is involved, families of deceased victims can file a wrongful death claim seeking compensation for medical or funeral expenses, lost future earnings, loss of companionship and other related damages. Injured victims can seek compensation to cover medical expenses, loss of wages, hospitalization, medication and rehabilitation costs.
