Kevin Payne, 50, was killed in a Los Angeles car accident after being hit while standing near his disabled Toyota pickup truck by the side of 210 Freeway.
According to a news report in the San Gabriel Valley Tribune, the fatal crash occurred the night of August 27, 2010 in the westbound lanes of the freeway, in Glendora, close to the 57 Freeway. California Highway Patrol officials say Payne was standing by the side of the road and near his Mercedes sedan while having the pickup truck hooked on to a tow truck. At that moment he was struck by a 2009 Dodge van driven by 36-year-old Toby Okleshen.
Officials say Okleshen swerved to the right and struck the back of the Mercedes, which struck Payne and threw him against the bed of the Toyota truck. Payne was transported to a local hospital where he died. Witnesses told officials that Okleshen was driving erratically just before the crash. Investigators believe Okleshen may have lost control of his vehicle because he is diabetic and his blood sugar was very low at the time. An investigation is ongoing.
I offer my deepest condolences to the family and friends of Kevin Payne for their tragic and heartbreaking loss. Please keep them in your thoughts and prayers.
Car Accident Statistics
According to CHP’s 2008 Statewide Integrated Traffic Records System (SWITRS), there were four fatalities and 252 injuries involving car accidents in Glendora. In Los Angeles County as a whole, 667 people died and 52,229 were injured as a result of car accidents during the same year.
Accident Causes and Liability Issues
Based on this news report, officials are saying that Okleshen was not under the influence of alcohol or drugs. However, I trust officials are also looking into whether there was any negligence or wrongdoing in this incident. If Okleshen is determined to have been at fault, he could be held liable for Payne’s wrongful death. In cases where negligence or wrongdoing is involved, families of deceased victims can file a wrongful death claim seeking compensation for medical and funeral expenses, lost future income, loss of love and companionship, and other related damages.
In such cases, families of deceased car accident victims would be well-advised to contact an experienced Los Angeles personal injury lawyer, who will stay abreast of the official investigation and make sure that their legal rights and best interests are protected. The best personal injury law firms will always offer a free consultation and comprehensive claim evaluation to injured victims and their families.
