Los Angeles DUI Collision Proves Fatal for Pedestrian

A 42-year-old pedestrian was fatally injured in a Los Angeles car accident after he was struck by a suspected drunk driver. According to a CBS news report, the fatal pedestrian accident occurred at the intersection of California Street and Pacific Boulevard in Walnut Park early morning on April 18, 2011. The motorist, 23-year-old Luis Jimenez was traveling east on California when he ran a stop sign, lost control of his car and hit the pedestrian. The pedestrian was killed in the crash. Jimenez sustained minor injuries, and was arrested on suspicion of DUI and vehicular manslaughter.

I offer my deepest condolences to the family and friends of this deceased pedestrian. Please keep them in your thoughts and prayers.

Los Angeles Accident Statistics

According to California Highway Patrol’s 2008 Statewide Integrated Traffic Records System (SWITRS), there were 667 fatalities and 52,229 injuries in Los Angeles County car accidents. Of those, 258 deaths and 4,832 injuries were attributed to DUI collisions. Also, countywide, 214 people died and 4,985 were injured as a result of pedestrian accidents during the same year.

Drunk Driving Laws

Based on this news report, the driver, Jimenez, not only ran a stop sign at the intersection, but also lost control of the vehicle and crashed into a pedestrian because, officials say, he was possibly under the influence. It is illegal in California to operate a motor vehicle under the influence of alcohol and/or drugs.

According to California Vehicle Code Section 23152 (a): “It is unlawful for any person who is under the influence of any alcoholic beverage or drug, or under the combined influence of any alcoholic beverage and drug, to drive a vehicle.” A driver whose act of driving under the influence results in the death of another person will likely face vehicular manslaughter charges, as Jimenez does in this case.

Claims for Compensation

In such accidents where negligence or wrongdoing is involved, families of deceased victims would be well-advised to retain the services of a reputed Los Angeles personal injury lawyer, who has the experience as well as a successful track record of holding drunk drivers financially responsible. A skilled car accident attorney will also be able to inform families about how their own car insurance policy might apply to an incident where the at-fault motorist is uninsured or underinsured.
