Los Angeles Motorcycle Accident Proves Fatal

A 23-year-old Burbank man was killed in a motorcycle accident in Los Angeles after he hit the rear of another motorcycle. According to a news report in the Daily Breeze, both motorcyclists fell off their vehicles the afternoon of April 10, 2011 on the 10 Freeway near West Los Angeles. The second motorcycle slid under the back of an Acura. The Burbank man was transported to a local hospital where he was pronounced dead. The other motorcyclist, a 29-year-old man from North Hollywood, was treated for injuries and arrested on suspicion of driving under the influence. No one else was injured. An investigation is ongoing.

I offer my deepest condolences to the family members and friends of this motorcyclist who was fatally injured in this accident. Please keep his grieving family in your thoughts and prayers.

Motorcycle Accidents

According to California Highway Patrol’s 2008 Statewide Integrated Traffic Records System (SWITRS), there were no fatalities, but 15 injuries reported as a result of motorcycle accidents in West Hollywood. In Los Angeles County as a whole, 114 people were killed and 2,934 were injured due to motorcycle accidents during the same year.

Was Drunk Driving a Factor?

Based on this news report, it is unclear as to which one of the motorcyclists caused this fatal accident. Driving any vehicle under the influence of alcohol and/or drugs is illegal under California law. According to California Vehicle Code Section 23152 (a): “It is unlawful for any person who is under the influence of any alcoholic beverage or drug, or under the combined influence of any alcoholic beverage and drug, to drive a vehicle.” It is not clear if this was a fatal DUI collision. The question here is: Did the motorcyclist believed to have been under the influence cause this tragic collision.

Fault and Liability

If it is determined that the motorcyclist was under the influence and caused the accident, then, he can be held liable for the victim’s wrongful death. Families of deceased accident victims in such cases can file a wrongful death claim seeking compensation for medical and funeral costs, lost future income and loss of love and companionship. An experienced Los Angeles personal injury lawyer will be able to better advise car accident victims or their families about their legal rights and options.
