Davidalia “Jose” Landaverde, 58, was killed in a Fontana car accident involving a collision with a Fontana police squad car. According to a CBS Los Angeles news report, the fatal collision occurred at the intersection of Juniper and Ceres avenues, the night of May 26, 2012. Officials say Landaverde was traveling west when an eastbound patrol car broadsided his vehicle. He was pronounced dead at a nearby hospital shortly after the crash. Two passengers, including 80-year-old Olga Mayorga, were injured in the incident. The police officer was treated for injuries as well before being released. Nearby residents have said that there was no sound of car brakes or a police siren. The investigation is ongoing.
My deepest condolences go out to the family and friends of Davidalia “Jose” Landaverde following this tragic car accident. Please keep them in your thoughts and prayers.
Fontana Car Accident Statistics
According to California Highway Patrol’s 2009 Statewide Integrated Traffic Records System (SWITRS), nine fatalities and 498 injuries were reported as a result of car accidents in the city of Fontana. During the same year, 223 people were killed and 7,870 were injured as a result of San Bernardino County car accidents.
What Caused This Fatal Collision?
Based on this news report, an investigation is underway to determine the cause of the crash. Witnesses have stated that the patrol car did not have its emergency lights on. If that’s true, which vehicle had the right-of-way at the intersection? Was either motorist speeding, distracted or otherwise negligent? Why doesn’t this intersection have traffic lights? There was a similar collision that occurred at the location with a police vehicle a couple of years ago and residents have since asked for the installation of traffic lights. I trust officials are looking into these and other issues in order to determine the cause of this fatal collision.
If the police officer is determined to have been at fault in this case, the officer and his employer can be held liable for the victim’s wrongful death and the passenger’s injuries. A knowledgeable Fontana car accident lawyer will be able to determine whether a dangerous intersection caused or contributed to this incident. If that was the case, the city or governmental agency responsible for maintaining the roadway can also be held liable. Under California Governmental Code Section 911.2, any personal injury or wrongful death claim against a governmental agency must be filed within 180 days of the incident.
