Police don’t suspect the involvement of alcohol or drugs. It was not clear if anyone was arrested and the name of the driver was not released. The investigation is ongoing.

Laws and Liability Issues
Based on this news report, it appears that the driver of the vehicle in this case ran a red light, swerved to avoid hitting another vehicle at the intersection and ended up striking a pedestrian who was standing or walking in the sidewalk. California Vehicle Code section 21453 (a) states: “A driver facing a circular red signal shall stop at the limit line before entering the crosswalk on the near side of the intersection or, if none, then before entering the intersection, and shall remain stopped until an indication to proceed is shown.”
We trust officials are looking into what caused this motorist to run a red light. Was he or she distracted by a cell phone or some other factor? Did recklessness, excessive speed or inattention play a part? In such cases, if a driver is believed to have been negligent he or she can be held liable for the victim’s wrongful death.
In cases where negligence or wrongdoing is involved, family members can seek compensation for damages such as medical expenses, funeral costs, lost future income, pain and suffering and loss of love, care and companionship. An experienced Orange County pedestrian accident lawyer can help victims and their families better understand their legal rights and options.
