Man Killed in Fountain Valley Pedestrian Accident

By

Tam Minh Vo, 57, was struck and killed in a Fountain Valley pedestrian accident by a driver who officials say ran a red light at an intersection. According to a news report in The Orange County Register, the fatal pedestrian accident occurred at the intersection of Warner Avenue and Los Jardines West on Dec. 30.

Police said the motorist drove into the intersection after running a red light and without the right of way. The driver then swerved in an attempt to avoid another vehicle and went on a curb crashing into Vo who suffered fatal injuries and died at the scene. Police don’t suspect the involvement of alcohol or drugs. It was not clear if anyone was arrested and the name of the driver was not released. The investigation is ongoing.

We offer our deepest condolences to the family members of Tam Minh Vo for their tragic loss. Please keep them in your thoughts and prayers.

Pedestrian Accident Statistics

According to California Highway Patrol’s 2015 Statewide Integrated Traffic Records System (SWITRS), there were two fatalities and 11 injuries involving pedestrian accidents in the city of Fountain Valley. In Orange County as a whole, 60 people died and 786 were injured as a result of pedestrian accidents during the same year.

Laws and Liability Issues

Based on this news report, it appears that the driver of the vehicle in this case ran a red light, swerved to avoid hitting another vehicle at the intersection and ended up striking a pedestrian who was standing or walking in the sidewalk. California Vehicle Code section 21453 (a) states: “A driver facing a circular red signal shall stop at the limit line before entering the crosswalk on the near side of the intersection or, if none, then before entering the intersection, and shall remain stopped until an indication to proceed is shown.”

We trust officials are looking into what caused this motorist to run a red light. Was he or she distracted by a cell phone or some other factor? Did recklessness, excessive speed or inattention play a part? In such cases, if a driver is believed to have been negligent he or she can be held liable for the victim’s wrongful death.

In cases where negligence or wrongdoing is involved, family members can seek compensation for damages such as medical expenses, funeral costs, lost future income, pain and suffering and loss of love, care and companionship. An experienced Orange County pedestrian accident lawyer can help victims and their families better understand their legal rights and options.
