Man Killed in Orange County DUI Pedestrian Accident

Francisco Yaxon, 44, died of fatal injuries he suffered in a Santa Ana pedestrian hit-and-run accident. According to this news report in The Orange County Register, the incident occurred the evening of February 1, 2009 in the 300 block of Newhope Street. A 2004 Mercedes Benz CLK 320 was traveling north on Newhope when a 1996 Chevy S10 pickup truck made a right turn in front of it. The Mercedes then clipped the back of the pickup, which forced it into Yaxon who was apparently walking on the east sidewalk of Newhope.

Yaxon was pinned against a wall. The driver of the pickup truck, Joel Torrejon Miranda, 40, of Santa Ana, fled the scene. He was arrested shortly afterward in his home. Miranda is being held on suspicion of felony hit-and-run, driving under the influence of alcohol and vehicular manslaughter. The driver of the Mercedes complained of pain, but did not suffer any major injuries.

My heart goes out to the family and friends of Francisco Yaxon, who died tragically in this unfortunate accident. This man was in the wrong place at the wrong time. I offer my deepest condolences to everyone who knew and loved Yaxon.

There is no question that the drunk driver in this case, Joel Torrejon Miranda, should be prosecuted to the fullest extent of the law. Based on this newspaper report, it seems to me that Miranda very likely caused this accident and is at fault because he was a intoxicated driver. Miranda then escaped from the scene of the accident when by law, he was required to wait for officials to arrive and do what he could to help the injured victim. Instead, he simply took off because he knew he was intoxicated and in trouble. Despicable!

According to the California Vehicle Code Section 20001 (a): “The driver of a vehicle involved in an accident resulting in injury to a person, other than himself or herself, or in the death of a person shall immediately stop the vehicle at the scene of the accident.”

The family of Francisco Yaxon would be well-advised to retain the services of an experienced Orange County pedestrian accident attorney who will help them hold the negligent parties and wrongdoers accountable.
