Rodolfo Mendez, 35, was ejected and killed in a San Bernardino County rollover accident, according to the Press-Enterprise news report. Mendez was thrown out of his Toyota Tacoma pickup truck when the vehicle overturned after he apparently missed a right turn on Mariposa Road near the Interstate 15 and drove into the desert. California Highway Patrol officials who responded the morning of January 21, 2009, found Mendez’s body in the open desert area between the I-15 and Mariposa Road near the intersection of Eucalyptus Street in Hesperia.
I offer my deepest condolences to everyone who knew and loved Rodolfo Mendez for their heartbreaking loss. Please keep them in your prayers.
According to the California Highway Patrol’s Statewide Integrated Traffic Reporting System, there were 12 fatal San Bernardino traffic accidents and 281 crashes that involved injuries in Hesperia in 2006. During that same year, in San Bernardino County as a whole, there were 351 deaths and 10,842 injuries reported involving auto accidents.
There is nothing in this report to indicate that Rodolfo Mendez was not wearing his seatbelt. So the question here is how Mendez got ejected. There is also no explanation yet about why he missed the turn and drove into the desert. Did he lose control of his steering? Was there a mechanical malfunction in the Tacoma that caused him to lose control of the pickup truck? Obviously, these are questions that need to be answered.
Rodolfo Mendez’s family would be well-advised to contact an experienced auto product defect lawyer, who will determine whether a product defect or a mechanical malfunction triggered by a product defect caused Mendez’s fatal injuries. If I were representing this family, I would have the vehicle preserved in its current condition until it can be examined for product defects especially seatbelt defects and steering problems.
Plaintiffs who wish to pursue product liability cases must certainly start out by looking for a reputed auto product defect law firm whose attorneys have extensive experience going after large auto makers. The best attorneys will not charge any fees for initial
