Merced Motorcycle Accident Causes Major Injuries

Wallace Dunn, 53, sustained major injuries in a car accident in the Merced area after his motorcycle was struck by a car making a left turn on Highway 140. According to a news report in the Merced Sun Star, the injury crash occurred the afternoon of May 27, 2010 west of Arboleda Drive.

Dunn was riding a motorcycle west on the highway while 24-year-old Teresa Ledesma was driving a 1999 Ford Mustang east on the highway near Merced. California Highway Patrol officials said Ledesma then turned left into a private driveway directly in front of Dunn’s motorcycle. Dunn was thrown off the cycle and transported to a local hospital with major injuries.

I hope the motorcyclist in this case did not sustain catastrophic injuries as a result of this collision. I wish Dunn the very best for a speedy and complete recovery. He will be in my prayers.

Motorcycle Accident Statistics

According to California Highway Patrol’s 2008 Statewide Integrated Traffic Records System (SWITRS), there were no fatalities, but 12 injuries reported as a result of motorcycle accidents in Merced, California. Countywide, two people died and 55 were injured as a result of motorcycle accidents during the same year.

Right-of-Way Issues

Based on this news report, it appears that the driver of the Mustang, Teresa Ledesma, failed to notice the oncoming motorcycle as she made a left turn into the private driveway. In this case, the motorcyclist would have had the right-of-way and it appears that Ledesma failed to yield right-of-way to the oncoming motorcycle.

According to California Vehicle Code section 21801 (a): “The driver of a vehicle intending to turn to the left or to complete a U-turn upon a highway, or to turn left into public or private property, or an alley, shall yield the right-of-way to all vehicles approaching from the opposite direction which are close enough to constitute a hazard at any time during the turning movement, and shall continue to yield the right-of-way to the approaching vehicles until the left turn or U-turn can be made with reasonable safety.”

Claim for Compensation

In such cases, injured victims would be well-advised to retain the services of an experienced Modesto personal injury lawyer, who will explore all facets of the case and make sure that the negligent parties are held accountable. Injured victims could seek compensation from the at-fault party for medical expenses, loss of earnings, cost of hospitalization, surgery, medication and rehabilitation.

What are some of the precautions motorists can take at intersections to avoid collisions with motorcyclists or other oncoming vehicles?
