Motorcyclist Seriously Injured in Napa Car Accident


James Woolworth, 49, was injured in a motorcycle accident after he was struck by a vehicle that was making a left turn at a Napa intersection. According to a news report in the Napa Valley Register, the injury collision occurred the morning of June 3, 2010, at the intersection of Jefferson and Third streets in Napa.

Police said Nicole Shurtz-Shereen, 27, who was driving a 1999 Dodge Ram, was traveling west on Third Street. Woolworth was riding a 2000 Honda 1100 motorcycle east on Third Street. Shurtz-Shereen tried to make a left turn on to Jefferson when she hit the Honda motorcycle. Police believe Shurtz-Shereen failed to yield right-of-way to Woolworth. The motorcyclist sustained a broken left leg, fractured ribs, facial and spinal injuries. Shurtz-Shereen was not injured.

My heart goes out to Woolworth and his family for what they are going through at this time. I hope his injuries are not catastrophic and pray that he has a speedy and complete recovery.

According to California Highway Patrol’s 2008 Statewide Integrated Traffic Records System (SWITRS), there were three fatalities and 354 injuries involving car accidents in Napa. In Napa County as a whole, 15 people died and 770 were injured as a result of car accidents during the same year.

Yielding Right-of-Way

If the details of this news report are accurate, it appears that Shurtz-Shereen, the driver of the Dodge Ram, failed to yield right-of-way to an oncoming vehicle, in this case, the motorcycle. According to California Vehicle Code section 21801 (a): “The driver of a vehicle intending to turn to the left or to complete a U-turn upon a highway, or to turn left into public or private property, or an alley, shall yield the right-of-way to all vehicles approaching from the opposite direction which are close enough to constitute a hazard at any time during the turning movement, and shall continue to yield the right-of-way to the approaching vehicles until the left turn or U-turn can be made with reasonable safety.”
