Yasar Barakzai, 22, of Irvine was killed in a motorcycle accident after colliding with a Lyft vehicle in Costa Mesa near Orange Coast College the night of March 19. According to a report in the Daily Pilot, the fatal crash occurred near the intersection of Fairview Road and El Camino Drive. It appears Barakzai was traveling north on Fairview when the Lyft driver who was traveling west on El Camino made a left to go south on Fairview.
Officials said the driver of the Lyft vehicle had just completed a trip to the Mesa del Mar neighborhood and had no passengers at the time of the collision. Police say the driver was cooperative and did not show any signs of intoxication. The Costa Mesa Police Department’s Major Accident Investigation Team was called to the scene.
Anyone who saw the collision or may have more information about it is asked to contact Costa Mesa police at 714-754-5264.
We offer our deepest condolences to the family members of Yasar Barakzai for their tragic and heartbreaking loss. Please keep them in your thoughts and prayers.
Potential Left Turn Violation?
Based on this news report, it appears that the driver of the Lyft vehicle was making a left turn when he struck the oncoming motorcyclist. It is not clear who had the green light and whether the Lyft driver failed to yield the right of way to the oncoming motorcyclist.
California Vehicle Code Section 21801 (a) requires any driver who intends to make a left turn or U-turn to “yield the right-of-way to all vehicles approaching from the opposite direction which are close enough to constitute a hazard at any time during the turning movement, and shall continue to yield the right-of-way to the approaching vehicles until the left turn or U-turn can be made with reasonable safety.”
In this particular case, the report states the Lyft vehicle was not carrying passengers at the time. However, it is not clear if the rideshare driver was logged into the app or was on his way to pick up a passenger. Depending on the facts and circumstances of this case, the driver and/or the rideshare company may be held liable for the injuries, damages and losses caused.
Cases involving rideshare companies such as Uber and Lyft are complex because these companies have powerful defense attorneys and insurance companies who fight to protect their interests. If you have been injured in a Lyft accident, you need an experienced Orange County car accident lawyer on your side who has successfully handled accident cases against these rideshare companies.
