Motorcyclist Killed In Gardena

By

Herbert Herman Rivas, 43, was killed in a Los Angeles car accident, which police believe, may have been caused by a driver making a dangerous left-hand turn. According a news report in the Los Angeles Times, the fatal motorcycle accident occurred the afternoon of October 26, 2010 on Redondo Beach Boulevard in Gardena. Rivas was travelling eastbound on Redondo Beach Boulevard on his motorcycle when he crashed into a Toyota Sienna van that was turning left on Budlong Avenue. Rivas was transported to a local hospital where he died. Police are seeking information from anyone who may have witnessed the fatal car accident.

My deepest condolences go out to the family and friends of Herbert Herman Rivas. My thoughts and prayers are with this grieving family.

Motorcycle Accident Statistics

According to California Highway Patrol’s 2008 Statewide Integrated Traffic Records System (SWITRS), nine people were injured in Gardena motorcycle accidents. During that same year, there were 114 fatalities and 2,934 injuries reported as a result of Los Angeles County motorcycle accidents.

What Caused This Fatal Car accident?

Police have not determined who was at fault for this fatal accident, but it appears that the driver of the van may have been making a dangerous left-hand turn. California Vehicle Code Section 21801 (a) states: “The driver of a vehicle intending to turn to the left or to complete a U-turn upon a highway, or to turn left into public or private property, or an alley, shall yield the right-of-way to all vehicles approaching from the opposite direction which are close enough to constitute a hazard at any time during the turning movement, and shall continue to yield the right-of-way to the approaching vehicles until the left turn or U-turn can be made with reasonable safety.”

Liability Issues

If the driver of the van is found to have been at fault, then he or she could be held civilly liable for Rivas’ wrongful death. In cases where negligence or wrongdoing is involved, the family of a deceased car accident victim could seek compensation for medical or funeral expenses, lost future income, loss of love and companionship, and other related damages. An experienced Los Angeles personal injury lawyer will be able to better advise families in such cases about their legal rights and options.
