A 30-year-old man was killed in a Riverside motorcycle accident the night of January 22, 2014 after his motorcycle collided with a vehicle exiting a school. According to a report in The Press-Enterprise, the fatal collision occurred when a 33-year-old Riverside man pulled out of Adams Elementary onto Colorado Avenue right into the path of the 2008 Suzuki motorcycle traveling east on Colorado. The motorcycle lay in pieces in the street. The motorcyclist died from his injuries. Investigators are still trying to determine who was at fault.
Our thoughts and prayers go out to the family of the deceased motorcyclist. We offer our heartfelt condolences to them.
Motorcycle Accidents in Riverside
According to California Highway Patrol’s 2011 Statewide Integrated Traffic Records System (SWITRS), one person died and 93 were injured due to motorcycle crashes in Riverside. Countywide, 18 fatalities and 533 injuries were reported as a result of motorcycle accidents during the same year.
Based on this news report, this accident occurred when the vehicle exiting a school failed to yield the right-of-way to the motorcyclists. I trust officials are looking into whether the driver was impaired, distracted, inattentive or otherwise negligent or reckless.
Under California law, drivers pulling out of public or private driveways must yield right-of-way to pedestrians and oncoming vehicles. According to California Vehicle Code Section 21804 (a): “The driver of any vehicle about to enter or cross a highway from any public or private property, or from an alley, shall yield the right-of-way to all traffic.” Vehicles entering traffic “shall continue to yield the right-of-way to that traffic until he or she can proceed with reasonable safety.”
Wrongful Death Claim
If the driver in this case is determined to have been at fault, he may be held liable for the motorcyclist’s wrongful death. Such claims, usually filed by immediate family members, seek compensation for damages such as lost future income, medical and funeral expenses and loss of love and companionship. Victims’ families would be well advised to contact an experienced Riverside Wrongful Death Lawyer who will stay on top of the official investigation and ensure that their legal rights and best interests are protected.
