Motorcyclist Killed in Los Angeles Car Accident

Joseph Annocki, 41, was killed in a Los Angeles motorcycle accident when a car struck his motorcycle. According to a news report in The Ventura County Star, the fatal motorcycle accident occurred near Geoffrey’s Restaurant on the Pacific Coast Highway in Malibu the night of March 16, 2011. Annocki was riding east on the highway, when a white sedan driven by 50-year-old Terry Turner pulled out of the parking lot of the restaurant, in front of the motorcycle. Annocki was killed in the crash. Turner and his passenger, Donna Martin, 47, were not injured in the accident. An investigation is ongoing.

My heartfelt condolences go out to the family and friends of Joseph Annocki. My thoughts and prayers are with them following this tragic motorcycle accident.

Motorcycle Accident Statistics

According to California Highway Patrol’s 2008 Statewide Integrated Traffic Records System (SWITRS), 22 people were injured in Malibu motorcycle accidents. During that same year, there were 114 fatalities and 2,934 injuries reported involving motorcycle accidents in Los Angeles County.

Right-of-Way Issues

It appears from the report that the driver of the sedan pulled into traffic without properly yielding right-of-way to the motorcycle rider. According to California Vehicle Code 21804 (a): “The driver of any vehicle about to enter or cross a highway from any public or private property, or from an alley, shall yield the right-of-way to all traffic.” Vehicles entering traffic “shall continue to yield the right-of-way to that traffic until he or she can proceed with reasonable safety.”

Liability Issues

I trust officials are also looking into whether the driver of the car was impaired, distracted, inattentive or otherwise negligent at the time of the accident. If the driver is determined to have been at fault, he could be held liable for Annocki’s wrongful death. An experienced Los Angeles personal injury lawyer will be able to better advise victims’ families in such cases about their legal rights and options.

A skilled car accident lawyer should be able to determine whether a dangerous condition on the roadway may have caused or contributed to the incident. If that was the case, the city or governmental agency responsible for maintaining the roadway could be held liable as well. Under California Government Code Section 911.2, any personal injury or wrongful death claim against a public entity must be filed within 180 days of the incident.
