Multi-Vehicle DUI Collision Causes Injuries

Two people were injured in a car accident in Willits, which officials say, was caused by a suspected drunk driver. According to a report in The Willits News, the injury car accident occurred on Sherwood Road the night of January 10, 2011 when a Chevy Blazer driven by 42-year-old Ricky Brackett passed a slower moving Expedition pulling out directly into the path of an oncoming minivan and colliding with it head-on.

The Toyota Sienna minivan, driven by Graciela Gaona, 43, rolled over on impact. The Blazer tipped over to its side. The driver of the Expedition, 34-year-old Adam Tyler, was not injured. Brackett and Gaona had to be extricated from their respective vehicles and sustained injuries. Brackett was arrested on suspicion of felony DUI causing injury.

My heart goes out to Gaona, who appears to have been seriously injured when her vehicle rolled over. I wish her the very best for a speedy and complete recovery. It is indeed fortunate that the other driver, Tyler, was uninjured.

DUI Statistics

According to California Highway Patrol’s 2008 Statewide Integrated Traffic Records System (SWITRS), there were 26 fatalities and 439 injuries in Mendocino County as a result of all traffic accidents. Of those, 16 deaths and 83 injuries were attributed to DUI collisions.

Possible Violation of Laws

Based on this news report, Brackett was under the influence at the time of the car accident. It is against the law in California to operate a motor vehicle with a blood alcohol concentration of 0.08 percent or higher. According to California Vehicle Code Section 23152 (a): “It is unlawful for any person who is under the influence of any alcoholic beverage or drug, or under the combined influence of any alcoholic beverage and drug, to drive a vehicle.” In this case, it also appears that Brackett may have made an unsafe pass.

Victims’ Claim for Compensation

In such cases, injured victims would be well-advised to seek the counsel of an experienced California personal injury lawyer, who has a successful track record of holding drunk drivers financially responsible for their actions. Injured victims can seek compensation for medical expenses, loss of wages, cost of hospitalization, rehabilitation and other related damages.
