Four people were injured in an Orange County car accident, which involved two vehicles. According to a news report in The Orange County Register, the injury accident occurred on the 405 Freeway near Talbert Avenue in Fountain Valley the morning of November 26, 2010. California Highway Patrol officials say a Mercedes Benz was rear-ended by a Jeep Cherokee, which then rolled onto its roof. Three passengers in the Mercedes and one passenger in the Jeep were injured in the car accident. All the injured occupants were taken to an area hospital for treatment. An investigation is ongoing.
My thoughts and prayers are with the injured victims of this Orange County car accident. I wish them all a complete and prompt recovery from their injuries.
Orange County Car Accident Statistics
According to CHP’s 2008 Statewide Integrated Traffic Records System (SWITRS), there were three fatalities and 377 injuries involving car accidents in Fountain Valley. During that same year, 152 people died and 13,414 were injured as a result of car accidents in Orange County.
Based on this news report, it appears that the Mercedes was hit hard from behind by the Jeep. It is not clear at this point whether speed or inattention led to this car accident. Rear-end accidents are often caused by drivers following too close behind another vehicle or by distracted drivers.
California Vehicle Code Section 21703 states: “The driver of a motor vehicle shall not follow another vehicle more closely than is reasonable and prudent, having due regard for the speed of such vehicle and the traffic upon, and the condition of, the roadway.” California Vehicle Code Section 21704 also states that the driver “shall keep the vehicle he is driving at a distance of not less than 300 feet to the rear of any other motor vehicle subject to such speed restriction which is preceding it.”
If the driver of the Jeep is determined to have been at fault here, then he or she could be held liable for the injuries and damages caused. Injured victims in such cases can seek compensation for medical expenses, loss of wages, cost of hospitalization, rehabilitation and other related damages. An experienced Orange County personal injury lawyer will be able to better advise car accident victims about their legal rights and options.
