Orange County Auto Accident Kills Motorcyclist


Mihaela “Roxana” Zagoni, 26, of Mission Viejo died in a Laguna Niguel motorcycle accident Sept. 17 after her motorcycle collided with a Volkswagen Jetta near Aliso Creek Road and Moulton Parkway. According to an article in The Orange County Register, Zagoni was riding her motorcycle south on Aliso Creek Road when the collision occurred.

A reader, who lives across the street from the accident scene, commented on the Register’s Web site that the Jetta probably made a left onto Aliso Creek and hit Zagoni. Another reader, who had seen the accident, said Zagoni was thrown off her motorcycle on impact and that she fell at least 50 feet away. Officials say Zagoni suffered fatal head injuries despite wearing a helmet. The driver of the Jetta was uninjured.

I offer my deepest condolences to the family of Mihaela Zagoni for their irreparable loss. Zagoni reportedly started riding only a few months ago and was a member of OC Moto, a local group of motorcycle aficionados.

It’s too early to tell how this motorcycle accident occurred. The fact there were witnesses to the collision helps in finding out whether the driver of the Jetta failed to yield the right-of-way to Zagoni. If I were representing Zagoni’s family, I would have the accident site examined thoroughly for evidence and reconstruct the crash to determine whose fault it was. I would have Zagoni’s motorcycle closely examined as well for product defects, mechanical malfunctions and other evidence. I’m sure traffic investigators will look into whether the driver of the Jetta was under the influence of alcohol or drugs.

The family of Mihaela Zagoni would be well advised to retain the services of an experienced Orange County motorcycle accident attorney. If the driver of the Jetta is determined to be responsible, then he or she could be held liable for the accident and fatal injuries.

A skilled personal injury lawyer will certainly look at this Laguna Niguel street intersection to see if a dangerous condition exists and if intersection had a role in the accident. If there was a dangerous condition on the roadway that caused the crash, then the city of Laguna Niguel may be held liable. Please remember that any claim against a government agency in California must be filed within six months of the accident.

    YES, I totally agree. It would be wise to conduct a full investigation on Roxana and her family’s behalf. She was my dear friend, I do hope and pray that she did not die in vain due to some idiot’s foolishness or a street mishap.
