One Injured in Orange County Car Accident

One person was seriously injured in an Orange County car accident involving two vehicles. According to a news report in The Orange County Register, the injury car accident occurred the morning of December 7, 2010 when a Chevrolet Impala and a Nissan Altima collided at the intersection of South Harbor Boulevard and Orangefair Mall. Firefighters had to extricate a passenger in the Nissan. He was transported to a local hospital for treatment of his injuries. Both drivers were uninjured. Investigators are trying to determine the cause of this car accident.

My heart goes out to this injured victim. I wish him the very best for a speedy and complete recovery. He will certainly be in my thoughts and prayers.

Car Accident Statistics

According to California Highway Patrol’s 2008 Statewide Integrated Traffic Records System (SWITRS), there were four fatalities and 743 injuries involving car accidents in Fullerton. In Orange County as a whole, 152 people died and 13,414 were injured due to car accidents during the same year.

Right-of-Way Issues

Based on this news report, it is not clear which one of the drivers caused this car accident. It appears that this car accident occurred at a street intersection. It is possible that one of the drivers failed to yield right-of-way or ran a red light at the intersection. California Vehicle Code Section 21453 (a) states: “A driver facing a circular red signal shall stop at the limit line before entering the crosswalk on the near side of the intersection or, if none, then before entering the intersection, and shall remain stopped until an indication to proceed is shown.” I trust officials are also looking into whether one of the drivers was impaired, distracted, speeding or otherwise negligent at the time.

Fault and Liability

In such cases, the driver who is determined to have been at-fault could be held financially responsible for the injuries, damages and losses caused to the victim. Injured victims would be well-advised to contact an experienced Orange County personal injury lawyer, who will analyze all facets of the incident and make sure that the negligent parties are held liable for their actions. A skilled car accident lawyer will also be able to determine whether a dangerous intersection caused or contributed to the accident. If that was the case, the city or governmental agency responsible for maintaining that roadway could also be held liable. Please remember that any personal injury claim against a California public entity must be properly filed within six months of the incident.
