Orange County Pedestrian Accident Injures Teen

An Orange County teenager suffered serious head injuries in a Westminster pedestrian accident after he was struck by a vehicle while crossing Golden West Street on October 19, 2008. According to an article in The Orange County Register, the teenager, who has not yet been identified, was walking with his skateboard across Golden West Street at Sowell Street when he was hit by a southbound vehicle.

Westminster police officials say they don’t believe speeding or alcohol/drugs were involved in this 10/19/08 incident. Initial reports from police traffic investigators also show that driver’s negligence was not a factor in this accident.

Please keep this young man and his family in your prayers. I wish him the very best for a speedy and complete recovery.

According to California Highway Patrol’s Statewide Integrated Traffic Reporting System, in 2006, there were three pedestrian accident related fatalities in Westminster and 39 injuries involving pedestrian accidents. For all of Orange County, in 2006, there were 45 deaths and 802 injuries involving pedestrian accidents.

California Vehicle Code Section 21950 states: “The driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection.” The same section also states that the driver of a vehicle approaching a pedestrian within any marked or unmarked crosswalk “shall exercise all due care and shall reduce the speed of a vehicle or take any other action relating to the operating of the vehicle as necessary to safeguard the safety of the pedestrian.”

The family of the injured victim would be well-advised to seek the counsel of a reputed Orange County pedestrian accident attorney, who will be able to look into this incident further and determine who was at fault and who should be held responsible. Very often, initial official investigations turn out to be erroneous. Victims and their families need a skilled personal injury attorney on their side fighting for their rights.

A knowledgeable pedestrian accident lawyer will also look into whether there was a dangerous condition on that roadway or street intersection. If that is found to be the case, the city of Westminster could be held liable for this pedestrian accident. California Government Code Section 911.2 states that a personal injury claim against a government agency must be properly filed within six months of the date of injury.
