Passenger Seriously Injured in Ventura DUI Collision

A female passenger suffered major injuries in a Ventura car accident, which officials report, involved a suspected drunk driver. According to a news article in The Ventura County Star, the DUI crash occurred on Madera Road in Simi Valley, the evening of November 5, 2011. Officials say Donna Hebert, 43, failed to negotiate a curve on the roadway, crossed all southbound lanes of traffic, and struck several call boxes. The vehicle then came to rest in a drainage ditch. Hebert’s passenger sustained lacerations to her head and several broken ribs. Hebert was evaluated for injuries before being arrested on suspicion of driving under the influence while causing injury.

My thoughts and prayers are with the woman injured in this Ventura crash. I wish her the best for a complete and speedy recovery.

Ventura DUI Statistics

According to California Highway Patrol’s 2009 Statewide Integrated Traffic Records System (SWITRS), 35 people were injured in alcohol-related car accidents in Simi Valley. During that same year, there were 23 fatalities and 392 injuries reported as a result of Ventura County DUI collisions.

California DUI Law

Based on this news report, it appears that the driver, Hebert, was under the influence of alcohol when she lost control of her vehicle. According to California Vehicle Code Section 23152 (a): “It is unlawful for any person who is under the influence of any alcoholic beverage or drug, or under the combined influence of any alcoholic beverage and drug, to drive a vehicle.” The same section also states that it is illegal for drivers to operate a motor vehicle with a blood alcohol concentration of 0.08 percent or higher.

Liability Issues

In such cases where negligence or wrongdoing is involved, the injured victim can file a personal injury claim seeking compensation for medical expenses, lost wages, the cost of rehabilitation services, and other related damages. Victims of drunk drivers would be well advised to contact an experienced Ventura personal injury lawyer with a proven track record of financially pursuing drunk drivers.
